ACCEPTANCE OF TERMS

These Terms and Conditions constitute a legally binding agreement between you and Believe QB Academy LLC. By accessing or using our website, mobile applications, services, or participating in any programs, you agree to be bound by these Terms.

• "Services" means all programs, courses, training, coaching, websites, applications, and related services provided by Believe QB Academy LLC

• "Content" means all text, graphics, images, videos, audio, software, and other materials available through our Services

• "User Content" means any content you submit, upload, or transmit through our Services

• "Intellectual Property" means all proprietary rights including copyrights, trademarks, trade secrets, and patents

DESCRIPTION OF SERVICES​

1. TRAINING PROGRAMS

Believe QB Academy LLC provides quarterback training services including:

• Individual and group coaching sessions

• Technical skill development programs

• Mental performance training

• Video analysis and feedback

• Camps, clinics, and workshops

• Online educational content and resources

2. DIGITAL SERVICES

• Online learning platforms and courses

• Mobile applications and software tools

• Video libraries and educational materials

• Progress tracking and analytics

• Communication and scheduling tools

ELIGIBILITY AND REGISTRATION​​

1. AGE REQUIREMENTS

• Participants must be at least 8 years old

• Users under 18 must have parental/guardian consent

• Parent/Guardian must accept these Terms on behalf of minors

2. ACCOUNT REGISTRATION

• You must provide accurate and complete information

• You are responsible for maintaining account security

• You must notify us immediately of any unauthorized access

• One person per account; sharing accounts is prohibited

​

3. MEDICAL CLEARANCE

• All participants must have current medical clearance for physical activity

• You must disclose any medical conditions that may affect participation

• We reserve the right to require medical documentation

PAYMENT TERMS​

1. FEES AND CHARGES

• All fees are due in advance unless otherwise specified

• Prices are subject to change with 30 days notice

• Additional fees may apply for specialized services or equipment

• Late payment fees may be assessed for overdue accounts

2. PAYMENT METHODS

• We accept major credit cards, debit cards, and electronic transfers

• Auto-renewal applies to subscription services unless cancelled

• Failed payments may result in service suspension

​

3. REFUND POLICY

• Refunds are governed by our separate Refund Policy

• Refund requests must be submitted according to policy guidelines

• Processing fees are non-refundable

USER CONDUCT AND RESPONSIBILITIES

1. ACCEPTABLE USE

You agree to:

• Use Services only for lawful purposes

• Follow all facility rules and safety guidelines

• Respect other participants, staff, and property

• Maintain appropriate conduct during all activities

• Complete required waivers and documentation

2. PROHIBITED CONDUCT

You may not:

• Engage in disruptive, abusive, or threatening behavior

• Use Services for any illegal or unauthorized purpose

• Violate any applicable laws or regulations

• Interfere with or disrupt Services or servers

• Attempt to gain unauthorized access to any systems

• Share account credentials or access with others

3. CONSEQUENCES OF VIOLATIONS

• Immediate termination of Services without refund

• Legal action for damages or violations

• Reporting to appropriate authorities when necessary

INTELLECTUAL PROPERTY RIGHTS​

1. COMPANY INTELLECTUAL PROPERTY

• All Content is owned by or licensed to Believe QB Academy LLC

• Protected by copyright, trademark, and other intellectual property laws

• No license or right is granted except as expressly provided

2. LIMITED LICENSE TO USERS

• Personal, non-commercial use only

• May not copy, modify, distribute, or create derivative works

• License terminates upon violation of these Terms

3. USER CONTENT

• You retain ownership of content you submit

• You grant us a license to use, modify, and display your content

• You represent that you have rights to all submitted content

• We may remove User Content at our discretion

HEALTH AND SAFETY​

1. ASSUMPTION OF RISK

You acknowledge that:

• Athletic activities involve inherent risks of injury

• Participation is voluntary and at your own risk

• We cannot guarantee your safety or prevent all injuries

• You assume full responsibility for your health and safety

2. MEDICAL CONDITIONS

• You must disclose any medical conditions or limitations

• You are responsible for following medical advice

• We reserve the right to exclude participants for safety reasons

• Emergency medical treatment may be sought if necessary

3. INSURANCE

• You are responsible for your own health insurance

• We recommend maintaining adequate coverage

• Our liability insurance does not cover participant injuries

PRIVACY AND DATA PROTECTION:

• By using Services, you consent to our privacy practices

2. COMMUNICATIONS

DISCLAIMERS AND WARRANTIES:

• No guarantee of athletic improvement or results

• Individual results depend on effort, ability, and other factors

• Past performance does not predict future results

3. WARRANTY DISCLAIMER

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY​

1. GENERAL LIMITATIONS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELIEVE QB ACADEMY LLC SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

• LOSS OF PROFITS, DATA, OR USE

• PERSONAL INJURY OR PROPERTY DAMAGE

• DAMAGES EXCEEDING THE AMOUNT PAID FOR SERVICES

2. EXCEPTIONS

Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

INDEMNIFICATION

You agree to indemnify and hold harmless Believe QB Academy LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of Services

• Your violation of these Terms

• Your violation of any law or regulation

• Your User Content or conduct

TERMINATION​

1. TERMINATION BY YOU

• You may terminate your account at any time

• Cancellation policies apply to ongoing services

• Some obligations survive termination

2. TERMINATION BY US:

We may terminate your access immediately for:

• Violation of these Terms

• Illegal or harmful conduct

• Non-payment of fees

• Safety concerns

3. EFFECT OF TERMINATION

• All rights and licenses terminate immediately

• You must cease all use of Services

• Certain provisions survive termination

DISPUTE RESOLUTION:

1. GOVERNING LAW

These Terms are governed by the laws of Alabama without regard to conflict of law principles.

2. ARBITRATION

• All disputes shall be resolved through binding arbitration

• Arbitration conducted under American Arbitration Association rules

• Location: Mobile, AL

• You waive right to jury trial and class action participation

 

3. EXCEPTIONS

Small claims court actions and injunctive relief may be pursued in court.

GENERAL PROVISIONS:

1. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Believe QB Academy LLC regarding use of Services.

2. MODIFICATIONS

• We may modify these Terms at any time

• Material changes will be communicated with 30 days notice

• Continued use constitutes acceptance of changes

3. SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

4. WAIVER

No waiver of any provision shall be deemed a waiver of any other provision or of the same provision on a future occasion.

5. ASSIGNMENT

• You may not assign these Terms without our written consent

6. FORCE MAJEURE

We are not liable for delays or failures due to circumstances beyond our reasonable control.
